DMCA Policy

How Creek handles copyright infringement claims.


Effective Date: March 28, 2026

SolCreek, Inc. ("Creek") respects the intellectual property rights of others and expects users of the Services to do the same. Creek responds to notices of alleged copyright infringement in accordance with the Digital Millennium Copyright Act ("DMCA"), 17 U.S.C. Section 512.

If you believe that content deployed on Creek infringes your copyright, please send a written notice to our designated DMCA agent containing the following:

  1. Identification of the copyrighted work you claim has been infringed, or a representative list if multiple works are involved
  2. Identification of the material you claim is infringing, with enough information for us to locate it (e.g., the URL of the deployment)
  3. Your contact information -- name, address, telephone number, and email address
  4. A statement that you have a good faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law
  5. A statement that the information in the notice is accurate, and under penalty of perjury, that you are authorized to act on behalf of the copyright owner
  6. Your physical or electronic signature

What Happens After a Notice

Upon receiving a valid DMCA notice, Creek will:

  1. Promptly remove or disable access to the allegedly infringing material
  2. Notify the user who deployed the material
  3. Provide the user an opportunity to submit a counter-notification

Counter-Notification

If you believe your content was removed in error, you may submit a counter-notification containing:

  1. Identification of the material that was removed and its location before removal
  2. A statement under penalty of perjury that you have a good faith belief the material was removed by mistake or misidentification
  3. Your name, address, telephone number, and a statement consenting to the jurisdiction of the federal court in San Francisco County, California
  4. Your physical or electronic signature

Upon receiving a valid counter-notification, Creek will forward it to the complaining party. If the complaining party does not file a court action within 10 business days, Creek may restore the removed material.

Repeat Infringers

Creek will terminate, in appropriate circumstances, the accounts of users who are repeat infringers of copyright.

False Claims

Under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material is infringing, or that material was removed by mistake, may be subject to liability for damages, including costs and attorneys' fees.
